COPPA (Children Online Privacy Protection Act)

We do not specifically market to children under the age of 13 years old.

CAN-SPAM Act
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

• Process orders and to send information and updates pertaining to orders.
• Send you additional information related to your product and/or service
• Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.
To be in accordance with CAN-SPAM, we agree to the following:
• Not use false or misleading subjects or email addresses.
• Identify the message as an advertisement in some reasonable way.
• Include the physical address of our business or site headquarters.
• Monitor third-party email marketing services for compliance, if one is used.
• Honor opt-out/unsubscribe requests quickly.
• Allow users to unsubscribe by using the link at the bottom of each email.

POLICIES
MEMBERSHIP POLICY
SWANITC Parties events are Member-Only events; as such a membership is required for all attendees. To become a member, interested parties must submit a Membership Application or Event Clearance Form and pay either an initial membership fee and/or event registration fee. Should a member’s membership payment lapse, payment of all outstanding back fees will be required, prior to attending any upcoming events. Members will continue to be billed/changed until membership is canceled by the member by logging into their Member Account and clicking Cancel Subscription. Please Note: It is the responsibility of the Member to cancel their subscription as SWANITC Events are not able to do so. Once the annual membership fee is charge, that charge will fall under our Refund Policy (see below).

Termination of Membership: An immediate termination of membership, rejection and/or ejection from an event, forfeiture of membership and all event registration-related costs and a ban on future membership and/or attending any future SWANITC Events may occur if the member is found to be in breach of SWANITC Events Website Terms, Conditions of Use and Policies, violates any rules, or any of the below:

misrepresentation of age, likeness, or info submitted to SWANTIC Events

registered for an event without being cleared by SWANITC Events staff

found to have shared the confidential event, website, registration, access codes, location or any relevant, patron personal/confidential information

are rude, disrespectful, harassing or threatening to our guests, staff members or event partners, either in person, via phone or email
OUR NO-SHOW POLICY
Due to the nature of our events, the approval and clearance process and donation deadlines also as stated on the event page, throughout our website, at the Point-of-Sale website and in your confirmation email, SWANITC Parties event registrations/sales are final and we unable to offer refunds to pre-purchased tickets. We have, however, implemented the below policy:
If you, the registrant, contact us (by email, texted, voice mail) TWO HOURS BEFORE the event start time to let us know that you will not be in attendance, we WILL honor your registration at THE NEXT scheduled event. This is ONLY ALLOWED ONCE. If you cannot attend the next scheduled event, you will forfeit your prepaid registration.
If you contact us AFTER the above cut off, unfortunately, you will forfeit your prepaid registration.
DOOR PAYMENT NO SHOW POLICY: If you register as a DOOR PAYMENT and cannot attend, you MUST notify us at least TWO hours prior to event start time. Otherwise, you will be removed from our guest list INDEFINITELY.
OUR REASONING:
We rely on our PRE-PAY REGISTRANTS to gauge whether or not to invite DOOR PAYMENT REGISTRANTS. If you, as a pre-paid registrant do not inform us of your inability to attend the event, you take a slot which could be used for a door pay registrant which ultimately cost us 85-150.00. In an effort not to overbook our events, we make the decision to invite/send location info to the DOOR PAY REGISTRANTS at 4:00 PM, again, depending on our prepays.
PLEASE NOTE: When we honor your registration at the next event, you MUST notify us of your desire to attend, PRIOR to Pre-Paid Registration ending.
EVENT POSTPONEMENT POLICY
Rarely do we postpone/reschedule an event. However, there are times that we, as event producers, will deem it best (i.e. weather, Washington, DC security alerts, the proportion of genders, etc).
We pride ourselves on having a great mixture/proportion of genders in attendance. If we feel that the proportion is off, we'll most likely reschedule the event so that no one feels uncomfortable. This is especially important for our BI events with M/F couples and single ladies registrations.
With this being said, if we postpone/reschedule an event, we will, of course, honor your registration at the next rescheduled/event date. If you cannot make the rescheduled/next event date, please follow our NO SHOW POLICY above.
PLEASE NOTE: Registration pricing MUST be equal to that of the NO-SHOW Event or Postponed Event. For example: If your registration cost for the first (no show/postponed) event was $ 45.00 and our next event’s registration cost is more than the $45.00, you CANNOT use the no-show/postponed event registration. You must also meet all criteria for the new event.
Postponed events are NOT canceled events. However, given the high level of logistical planning of such an intricate event, and now the COVID-19 global pandemic, new event dates may not be finalized for up to 1 year.
REFUND POLICY
We maintain a NO REFUND/ALL SALES FINAL Policy.
Unfortunately, due to the nature of our events, the approval and clearance process and donation deadlines and also as stated on the event page, throughout our website, at the Point-of-Sale website and in your confirmation email, SWANITC Event registrations/sales are final and we unable to offer a refund for any reason whatsoever. However, if in accordance with our NO SHOW & EVENT POSTPONEMENT Policies above, we will honor event registration at a future event.
CHARGEBACK POLICY
By making a payment for products or services, and to curtail and mitigate Chargeback Fraud & Friendly Fraud, you agree to take full personal responsibility for said payment(s) and agree not to dispute or chargeback said payment(s) for any reason whatsoever. Should a dispute or chargeback occur, you agree to be responsible for the following fees:
DISPUTE FEE
In the event the CARDHOLDER, AUTHORIZED USER, ACCOUNT HOLDER or FINANCIAL INSTITUTION rejects or disputes the charge or a chargeback occurs for any reason, SWANTIC Events/HNC Enterprises, Incorporated may charge the Member's credit card on file a DISPUTE FEE which includes the total amount of the disputed charge (original charge & fees) + $25 per transaction, + 4.5% processing fee (collectively Dispute Fee). If there is no credit card on file, a Dispute Invoice will be generated and the member will be required to pay the Dispute Invoice, AS WELL AS cancel/withdraw the dispute/chargeback within 24 hours of notice/receipt.
CHARGEBACK FEE
Should a dispute result from the abovementioned Dispute Fee, SWANITC Events/HNC Enterprises, Incorporated may charge the card on file a CHARGEBACK FEE which includes 250% of the full disputed/charged back amount (Chargeback Principle) + the original paid amount (Principle) and a 4.5% processing fee (collectively Chargeback Fee). If a credit card is not on file, a Chargeback Fee Invoice will be generated, and the cardholder will be required to pay the invoice within 24 hours of notice/receipt OR contact us to make payment arrangements.
Should a chargeback, dispute or financial institution rejection happen for any reason, or in cases of intentional violation of the above Chargeback Policy (also known as Chargeback or Friendly Fraud), the immediate termination of membership, rejection and/or ejection from an event, and forfeiture of membership and all event registration-related costs and a ban on future membership and/or attending any future SWANITC Events may occur. Should SWANITC Events pursue available legal remedies, including seeking monetary damages, injunctive relief, the customer/members shall be responsible for all attorney fees, court costs & collection costs.
ATTORNEY FEES, COURT COSTS & COLLECTIONS COSTS
In the event that any suit or action is instituted to enforce any provisions of these Terms, Conditions of Use and Policies, SWANITC Events/HNC Enterprises, Inc., shall be entitled to recover all fees, costs, and expenses of enforcing any Terms, Conditions of Use and Policies, including without limitation, all fees and expenses of attorneys and accountants, court costs, collection costs and expenses of appeals.
